Title
Authorizing the acceptance of a Public Sanitary Sewer Easement from Dane County and Madison Area Technical College for an existing sanitary sewer facility located at 1750 Pearson Street.
Body
WHEREAS, the County of Dane, ("Dane County") is the owner and Madison Area Technical College ("MATC") is the lessee of the property located at 1750 Pearson Street (the "Property"); and
 
WHEREAS, the Property is currently used by MATC for a fire service education center; and
 
WHEREAS, during a recent City of Madison ("City") site plan review for a new MATC fire service education facility, to be located on the Property, the City Engineering Division noted that there was no record of a recorded easement for an existing public sanitary sewer facility located along and adjacent to Pearson Street, that serves the Property; and
 
WHEREAS, as part of the City Engineering Division's review of said site plan, the City requested that Dane County and MATC grant a public sanitary sewer easement for the existing sanitary sewer facility, as currently located along Pearson Street; and
 
WHEREAS, Dane County and MATC desire to grant said public sanitary sewer easement to the City, at no cost to the City; and
 
WHEREAS, staff from the City of Madison Engineering Division and Office of Real Estate Services have reviewed and approve the acceptance of a public sanitary sewer easement for the existing sanitary sewer facility, as currently located along Pearson Street.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to accept a Public Sanitary Sewer Easement from the County of Dane ("Dane County") and Madison Area Technical College ("MATC") for an existing public sanitary sewer facility located at 1750 Pearson Street, as described on attached Exhibit A and depicted on attached Exhibit B.
