Title
Vacating a portion of Milwaukee Street, near the intersection of East Washington Avenue, being located in part of the Southeast 1/4 of the Northeast ΒΌ of Section 06, Town 07 North, Range 10 East, City of Madison, Dane County, Wisconsin. (6th AD).
Body
WHEREAS, the City of Madison Common Council approved Resolution No. RES-06-00618, File I.D. No. 03844, approving plans and specifications and authorizing the Mayor and City Clerk to enter into agreements with the Wisconsin Department of Transportation for the construction of East Washington Avenue Segment Three (Second Street to Marquette Street), which includes relocation of the existing intersection of Milwaukee Street and East Washington Avenue; and
WHEREAS, on January 3, 2006 the City of Madison Common Council approved Resolution No. RES-06-00034, File I.D. 02248, adopting the Transportation Project Plat No. 5992-06-29-4.01 for the acquisition land interests and/or entire property at 2609 East Washington Avenue (Marathon gasoline station) to facilitate the relocation of the existing intersection of Milwaukee Street and East Washington Avenue; and
WHEREAS, the City of Madison Real Estate Department is currently in the process of acquiring the subject property 2609 East Washington Avenue (Marathon gasoline station) under Real Estate Project No. 8390; and
WHEREAS, upon completion of the construction of the proposed relocation of Milwaukee Street and East Washington Avenue, surplus Milwaukee Street right-of-way will exist to the south of the new alignment adjacent to the "Union Corners" development; and
WHEREAS, the proposed "Union Corners" Development requests the vacation / discontinuance of the surplus portion of Milwaukee Street at the intersection with East Washington Avenue to enhance their proposed development; and
NOW THEREFORE BE IT RESOLVED, that the City Of Madison hereby conditionally discontinues and vacates the surplus portion of Milwaukee Street of under WI Ss 66.296(2) as shown on attached map and legal descriptions; and
NOW THEREFORE BE IT FURTHER RESOLVED, under Section 80.32(4), Wisconsin Statutes, any easements or incidental rights within the vacated right of ways are perpetuated unless specifically released as part of this vacation;
NOW THEREFORE BE IT FURTHER RESOLVED, that the City Clerk validate this street vacation by recordation with the Dane County Register of Deeds;
