This transfer of various vacated public right-of-way to adjoining landowners to facilitate future development ("Union Corners") of the site. No expenditure of City funds.

WHEREAS, the proposed "Union Corners" Development requests the vacation / discontinuance of platted Florence Street and Sullivan Street and portions of platted Winnebago Street to facilitate the proposed development; and

WHEREAS, the proposed "Union Corners" Development will require future requests of vacation / discontinuance of platted remaining portions of Division Street and Milwaukee Street to facilitate the proposed development; and

WHEREAS, the City Of Madison has various existing public sanitary sewer, public storm sewer and public water main within the proposed vacated/discontinued right of ways; and

NOW THEREFORE BE IT RESOLVED, that the City Of Madison retains 15 feet wide public easements over all existing public sanitary, storm and water main facilities located within vacated right of ways, unless the facilities are being abandoned as part of the "Union Corners" Development Plan; and

NOW THEREFORE BE IT RESOLVED, that the City Of Madison hereby conditionally discontinues and vacates all remaining portions of platted Florence Street and Sullivan Street and portions of platted Winnebago Street of under WI Ss 66.296(2) as shown on attached map and legal descriptions; and

NOW THEREFORE BE IT FURTHER RESOLVED, under Section 80.32(4), Wisconsin Statutes, any easements or incidental rights within the vacated right of ways are perpetuated unless specifically released as part of this vacation;
