Fiscal Note
The proposed resolution authorizes Frameshift Arts Café, LLC to use a City-owned transportation corridor for parking purposes. A lease relationship was established with the previous owner of the abutting property at 2262 Winnebago Street and Frameshift Arts Café, LLC desires to continue a similar lease. City Engineering has reviewed and approved the lease arrangement. Annual rent payable for the first lease year shall be in the amount of $327.66 and shall be deposited as General Fund revenue. Rent shall be subject to a five (5) percent increase every five years.

Body
WHEREAS, the City is the owner of the parcel located at 21 South Fourth Street (the “City’s Property”), which property is former railroad right-of-way and was acquired by the City for future transportation purposes; and

WHEREAS, Frameshift Arts Café LLC is the owner of abutting property located at 2262 Winnebago Street (the “Abutting Property”); and

WHEREAS, the Abutting Property was previously owned by IDUN (Sons of Norway) and benefitted from a lease with the City for the area that their parking lot encroached into the City’s Property; and

WHEREAS, Frameshift Arts Café LLC, as the new owner of the Abutting Property, desires to continue a similar lease relationship with the City (i.e., leasing a portion of the City’s Property for the purpose of maintaining and operating a parking lot, which use shall be ancillary to the business operations at the Abutting Property); and

WHEREAS, City of Madison Engineering Division staff have reviewed and approve of the lease arrangement.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to execute a lease (the “Lease”) with Frameshift Arts Café LLC (the “Lessee”), subject to the following terms ...
