Estimated maximum annual costs as listed in the agreement are $779,000 and funds will be provided in the Engineering Division 2017 Budget under 11069-84-200: 54810 (96330). Engineering staff is waiting for approval of calculations by the WDNR that will reduce this number substantially to $641,141.75

Body
WHEREAS, The City of Madison as a permitted municipal separate storm sewer system (MS4) by the WDNR and EPA is mandated by the Rock River TMDL, adopted and approved by those same agencies, to reduce phosphorous and sediment discharges to the Waters of the State; and

WHEREAS, the use of adaptive management represents the lowest total cost (sanitary and storm sewer) method for MMSD and the City to reach the phosphorous reductions required by the EPA and WDNR under the Rock River TMDL; and

WHEREAS, City Engineering, via the Storm Water Utility, has partnered with MMSD and multiple other groups and municipalities as part of a group known as Yahara Wins for the last four (4) years to complete a pilot of an adaptive management project; and

WHEREAS, Yahara Wins was begun by MMSD as a means to allow groups to meet the phosphorous reduction requirements mandated by the Rock River Total Maximum Daily Load (TMDL) enforced by the WDNR and EPA; and

WHEREAS, the pilot project has been sufficiently successful that the MMSD Board of Commissioners has authorized proceeding with full implementation of adaptive management as the primary means for MMSD to meet their TMDL phosphorus reductions;

NOW, THEREFORE, BE IT RESOLVED THAT:
