Fiscal Note
The proposed resolution authorizes a contract for Phase 3B final design/engineering services and Phase 4 construction design support services associated with the East-West Bus Rapid Transit (BRT) project. The contract price will not exceed $3.9 million. Funding is available within the BRT capital project within the Transportation Department's 2022 capital budget. No additional appropriation required.

Authorizing the City to execute a non-competitive service contract with AECOM Technical Services, Inc., for Phase 3B final (100%) design and engineering services, and Phase 4 (construction design support services) associated with the East-West Bus Rapid Transit project.
Body
WHEREAS Madison’s East-West Bus Rapid Transit project was recommended for Small Starts Funding by US DOT in May 2021; and
WHEREAS AECOM Technical Services Inc. was selected as the Phase 1 Bus Rapid Transit consultant lead based on a competitive RFP process via RFP #8706-0-2018-JA in 2018; and
WHEREAS, City Purchasing Ordinances provide under sec. 4.26(4)(b), of the Madison General Ordinances that, if the aggregate amount of the fee for services in a contract exceeds $50,000 and the contract was not subject to a competitive bidding process, the contract shall meet one of the other requirements of sec. 4.26(4) (a) and must be approved by the Common Council; and
WHEREAS, the Common Council passed a resolution (Item ID 56913 - adopted 10-1-19) authorizing the continued contracting with AECOM Technical Services Inc. throughout the project, with contract amounts subject to Common Council approval; and
WHEREAS, the Common Council passed a resolution (Item ID 67432 - adopted 10-5-21) authorizing the continued contracting with AECOM Technical Services Inc. for Phase 3A 60% and 90% design engineering services, and authorizing negotiation of a scope and contract for Phase 3B final (100%) design and engineering services, and Phase 4 (construction design support services) with the final contract amounts subject to Common Council approval; and
WHEREAS, engineering plans require professional licensure and cannot be transferred from one designer to another in the middle of the design process without significant re-work; and
WHEREAS, it is most efficient for the City of Madison to continue working with the AECOM Technical Services, Inc. team on the basis of time and quality, in order to meet the scheduled implementation of Bus Rapid Transit in 2024; and
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are authorized to execute a contract for Phase 3B final (100%) design and engineering services, and Phase 4 (construction design support services) from AECOM Technical Services, Inc. for an amount not exceed $3,900,000.
