Fiscal Note

The proposed resolution amends the 2024 Sustainability Improvements capital budget to reflect the receipt of $291,340 in formula grant funding from the U.S. Department of Energy's (DOE) Energy Efficiency and Conservation Block Grant (EECBG) Program. These funds, in addition to previously authorized general obligation borrowing in the Sustainability Improvements capital project, will be used for a competitively selected contract for $612,125 with OPEN Regenerative Technologies, Inc. to provide software and support services to implement the Building Energy Savings Program for the period March 1, 2024 through February 28, 2029. The contract includes an option to renew for two (2) additional two-year terms and the resolution authorizes the Purchasing Supervisor to execute the renewal options. The renewals would be subject to available funding at that time.

 

Title

Authorizing the Mayor and City Clerk to enter into a contract with OPEN Regenerative Technologies, Inc. to provide software and support services to implement the Building Energy Savings Program; and, when awarded, amending the 2024 Adopted Mayor's Office Sustainability Improvements Project Capital Budget to accept $291,340 in formula grant funding from the U.S. Department of Energy's (DOE) Energy Efficiency and Conservation Block Grant (EECBG) Program; and authorizing the Mayor and City Clerk to execute the associated grant agreement with U.S. DOE.

 

Body

WHEREAS, the Common Council created Section 29.40 and amending Section 1.08(3)(a) of the Madison General Ordinances to establish a Building Energy Savings code (ORD-23-00033); and,

 

WHEREAS, implementation of the Building Energy Savings code through the Building Energy Savings Program (BESP) will reduce carbon pollution by an estimated 91,257 to 136,886 tons per year, the equivalent of taking 17,838

to 26,757 cars off the road; and,

 

WHEREAS, the City of Madison issued a Request for Proposals (RFP) for software and support services for to implement the Building Energy Savings Program (BESP); and,

 

WHEREAS, City Purchasing facilitated and documented the RFP process and results, which received seven responses; and,

 

WHEREAS, OPEN Regenerative Technologies, Inc. was competitively selected among the responding vendors to provide the appropriate services; and,

 

WHEREAS, sufficient funding to launch the BESP was included in the 2024 Adopted Mayor's Office Sustainability Improvements Project Capital Budget; and,

 

WHEREAS, the City of Madison has been allocated $291,340 in formula grant funding from the U.S. Department of Energy's (DOE) Energy Efficiency and Conservation Block Grant (EECBG) Program and the Sustainability and Resilience program has submitted preliminary paperwork to DOE to initiate distribution of this funding to support the BESP; and,

 

WHEREAS, distribution of EECBG funding to the City of Madison by DOE will take several months; and,

 

WHEREAS, EECBG funding, when received, will be applied to reduce the amount of funding from the Sustainability Improvements Project Capital Budget applied to the contract with OPEN Regenerative Technologies, Inc.; and,

 

WHEREAS, under MGO 4.26(4), service contracts of more than 1 year and more than $100,000 per year in cost require Common Council approval and signature by the Mayor and City Clerk;

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to execute a contract between the City of Madison and OPEN Regenerative Technologies, Inc. in the amount of $612,125 for the period March 1, 2024 through February 28, 2029, with the option to renew for two (2) additional two-year terms, and the Purchasing Supervisor is authorized to execute the renewal options.

 

BE IT FURTHER RESOLVED, that the City of Madison is authorized to accept, when distributed, $291,340 in formula grant funding from the U.S. Department of Energy's (DOE) Energy Efficiency and Conservation Block Grant (EECBG) Program to fund a portion of the costs of implementing the BESP and take the following actions related to the EECBG formula grant funding:

 

1. Execute the associated grant agreement with U.S. DOE;

 

2. Amend the 2024 Adopted Mayor's Office Sustainability Improvements Project Capital Budget to accept the formula grant funding.

 

3. Amend the contract with OPEN Regenerative Technologies, Inc. to apply EECBG funding.

 

BE IT FINALLY RESOLVED that the Mayor and Clerk are hereby authorized to execute the above documents and any other documents related to this transaction in a form to be approved by the City Attorney.
