Repealing Section 5.02 of the Madison General Ordinances.

DRAFTER’S ANALYSIS:    This ordinance repeals Section 5.02 which created a Traffic Bureau. There is no statutory requirement to have a Traffic Bureau created by ordinance, nor are other specific aspects of the police department created by ordinance. All aspects of this Section are addressed and covered under current ordinances and CBAs. The repeal of this section has no impact on Madison Police Department operations or personnel, it should be viewed as a housekeeping change through the elimination of an unnecessary ordinance.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Section 5.02 entitled “Traffic Bureau” of the Madison General Ordinances is repealed.

 

 

 

 

EDITOR’S NOTE: Section 5.02 entitled “Traffic Bureau” of the Madison General Ordinances currently reads as follows:

 

5.02 - TRAFFIC BUREAU

(1)                     There is hereby created within the Madison Police Department a Traffic Bureau consisting of a Captain of Traffic, a Traffic Lieutenant and such other officers as may be detailed to such Traffic Bureau by the Chief of Police.

(2)                     Such Bureau shall be in charge and under the direction of an officer to be known as Captain of Traffic, who shall be appointed by the Chief of Police subject to the approval of the Police and Fire Commission.

(3)                     The Captain of Traffic shall make a thorough study of traffic conditions in the City of Madison, have full charge of the enforcement of traffic regulations, and full direction of said Traffic Bureau, subject only to the orders of the Chief of Police, and shall be charged with the duty of training and directing the members of the traffic squad.

(4)                     (a)                     There is hereby created a position to be known as Traffic Lieutenant, to be appointed by the Chief of the Police Department, subject to the approval of the Police and Fire Commissioners. The salary of such Traffic Lieutenant shall be the regularly established salary of a Police Lieutenant.
