ALTERNATE - Amending Section 33.01(7) of the Madison General Ordinances to permit Sub-units to remove officers and to schedule agenda items.

DRAFTER’S ANALYSIS:    This ordinance codifies state law which permits Sub-units or the Common Council to remove an officer of a Sub-unit, and also permits members of a Sub-unit to direct that matters be placed on a future agenda. This ordinance repeals current MGO 33.01(7)(b).

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Subdivision (a) of Subsection (7) entitled “Officers; Chairperson Restriction” of Section 33.01 entitled “Boards, Commissions, and Committees Procedures” of the Madison General Ordinances is amended as follows:

“(a)                     Sub-units shall, except as otherwise provided, choose their Chair, vice-chair and any other officers. Elections for officers shall be conducted at least every two (2) years, following election of Alders but may be held more often. annually, no later than June 30th of each year. Officers shall be chosen by secret ballot if requested by any member of the Sub-unit.

2.                     Subdivision (b) of Subsection (7) entitled “Officers; Chairperson Restriction” of Section 33.01 entitled “Boards, Commissions, and Committees Procedures” of the Madison General Ordinances is repealed and recreated as follows:

 “(b)                     Officers of Sub-units may be removed by the Sub-unit, at pleasure, or by the Common Council, for cause. Removals by the Common Council may be made only by an affirmative vote of three-fourths of all the members thereof, and by any Sub-unit consisting of 3 or more members, by an affirmative vote of two-thirds of all the members thereof.”

                     3.                     Subdivision (c) of Subsection (7) entitled “Officers; Chairperson Restriction” of Section 33.01 entitled “Boards, Commissions, and Committees Procedures” of the Madison General Ordinances is amended as follows:

“(c)                     Unless modified by a rule of a Sub-unit or as otherwise required by ordinance, tThe chair shall set the agenda for meetings, with the assistance of city staff as needed. By majority vote, the Sub-unit may direct that an item appear on the agenda of a future meeting, provided the Subject matter is under the jurisdiction of the Sub-unit. Every Sub-unit shall include an agenda item to accommodate requests to identify future agenda matters. Discussion regarding said matters shall be limited to the question of whether the item shall be included on a future agenda and shall not include discussion related to the substance of the proposed agenda item.

                     4.                     Subdivision (d) of Subsection (7) entitled “Officers; Chairperson Restriction” of Section 33.01 entitled “Boards, Commissions, and Committees Procedures” of the Madison General Ordinances is created as follows:

(d)                     No alderperson shall be the chairperson, co-chairperson, or vice-chairperson of any Sub-unit authorized to have more than two resident members appointed by the Mayor and confirmed by    the Common Council, except where an office is not filled by a non-Alder member of the Sub-unit. In no event shall alders serve as both chair and vice-chair of the same Sub-unit at the same time. In the event the resident chair and vice-chair are absent from a meeting, an alder, upon consensus of the members present, may assume the chair.

45.                     The title of Subsection (7) entitled “Officers; Chairperson Restriction” of Section 33.01 entitled “Boards, Commissions, and Committees Procedures” of the Madison General Ordinances is amended as follows:

“(7)                     Officers; Chairperson Restriction and Agendas”

“(b)                     No alderperson shall be the chairperson, co-chairperson, or vice-chairperson of any Sub-unit authorized to have more than two resident members appointed by the Mayor and confirmed by the Common Council. In the event the resident chair and vice-chair are absent from a meeting, an alder, upon consensus of the members present, may assume the chair. However, in no event shall an alder serve as chair of any such Sub-unit for more than two (2) consecutive meetings.”
