Title

Authorizing the City of Madison to execute an Underground Electric Easement to Wisconsin Power and Light Company, to occupy a portion of a City Engineering Stormwater Utility property located at 7105 Carnwood Road in the City of Madison.  (7th AD)

Body

WHEREAS, the City of Madison (“City”) is the owner of a Stormwater Utility property located at 7105 Carnwood Road in the City of Madison, Dane County, Wisconsin (“Property”); and

 

WHEREAS, Wisconsin Power and Light Company (“WP&L”) has existing facilities located within a portion of the Property without the benefit of easement rights; and

 

WHEREAS, WP&L requests a 20-foot-wide perpetual easement for underground electric utility purposes (“Easement”) from the City in, on, under, across and through a portion of the Property, as described on attached Exhibit A and depicted on attached Exhibit B (“Easement Area”); and

 

WHEREAS, the City reserves the right of reasonable use and occupation of the Easement Area, provided that such use and occupancy shall not interfere with or disturb the installation, operation, maintenance, repair, replacement and/or modification of the underground electric facilities.  If any reasonable use and occupation of the Easement Area by the City shall necessitate WP&L to remove or relocate the underground electric facilities or any part thereof, WP&L shall perform such work at such time as the City may approve, at the expense of WP&L; and

 

WHEREAS, the City’s Engineering Division has reviewed the request and agrees to grant the Easement to WP&L, with no consideration payable.

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Electric Easement to WP&L across a portion of the Property, legally described on attached Exhibit A and depicted on attached Exhibit B.
