Fiscal Note
The proposed resolution authorizes execution of a lease with Irwin A. and Robert D. Goodman Community Center, Inc. for a portion of City property adjacent to 214 Waubesa Street. The lease will accommodate building encroachments and for use ancillary to community center operations. Annual rent payable for the first lease year shall be in the amount of $2,665.00 and shall be deposited into the General Fund (MUNIS charge code 63026). Rent shall be subject to a five percent increase every five years.

Body
WHEREAS, the City is the owner of the parcel of land located at 152 Waubesa Street (the “City’s Property”), which property is former railroad right-of-way and was acquired by the City for future transportation purposes; and

WHEREAS, Irwin A. and Robert D. Goodman Community Center, Inc. (the “Owner”) is the new owner of property abutting the City’s Property located at 214 Waubesa Street (the “Abutting Property”); and

WHEREAS, the Owner is redeveloping the Abutting Property as a community center, and the existing building that will remain intact encroaches into the City’s Property; and

WHEREAS, the Owner desires to lease the Abutting Property from the City to accommodate the building encroachments and to also allow for the placement, installation and use of bike racks, landscaping and hardscaping improvements and open space use, which uses shall be ancillary to the community center operations at the Abutting Property; and

WHEREAS, the terms of a lease have been negotiated between the Office of Real Estate Services and the Owner.
