Authorizing the acceptance of a Quit Claim Deed from the State of Wisconsin Department of Transportation for surplus right-of-way located in the 2500 Block of University Avenue.
Body
WHEREAS, in the 1960s the City acquired, on behalf of The State of Wisconsin (the “State”), numerous parcels for the Campus Drive/University Avenue improvement project; and

WHEREAS, there is an approximately ½ acre of surplus State lands within the 2500 block of University Avenue (the “Surplus Lands”), which property, accessed from University Avenue, has been improved with a public parking lot (pursuant to Resolution File ID 2550, RES-12-00200, adopted 3/20/12), a public alley (pursuant to Resolution File ID 21573, RES-11-00247, adopted 3/15/11), a rain garden and other improvements, and which is currently maintained by the adjacent property owner, HUM-West Wilson Limited Partnership, pursuant to a Maintenance Agreement with the City; and

WHEREAS, the Surplus Lands are described on attached Exhibit A and depicted on attached Exhibit B; and

WHEREAS, earlier this year the State offered to transfer title of said Surplus Lands to the City via a Quit Claim Deed, at no cost to the City; and

WHEREAS, staff of the City of Madison Engineering Division, Office of Real Estate Services and City Attorney’s Office reviewed and approved of the Quit Claim Deed for such transfer; and

WHEREAS, on October 26, 2016 the State recorded the Quit Claim Deed for the Surplus Lands with the Dane County Register of Deeds, which conveyance is subject to certain conditions, including that the Surplus Lands are subject to existing zoning regulations, no new vehicular access to the highway from the Surplus Lands is allowed, no advertising signs or billboards are allowed on the Surplus Lands, and existing public and private utilities shall have continued occupancy over the Surplus Lands.
