Authorizing the execution of a Partial Release of Platted Building Setback document for Lot 1, Lot 42, and Lot 43 of the plat of Autumn Ridge Reserve.
Body
WHEREAS, during the review of the Preliminary Plat of Autumn Ridge Reserve (the “Prelim Plat”), the City of Madison (the “City”) required a 30-foot building setback restriction for proposed Lot 1, Lot 42, and Lot 43 (the “Lots”) abutting Elderberry Road dedication area as a condition of approval; and

WHEREAS, during the review of the Final Plat of Autumn Ridge Reserve (the “Final Plat”), City staff required additional Elderberry Road dedication area, thereby reducing the building setback requirement for the Lots by 10 feet; and

WHEREAS, the approval of the 10-foot reduction was not included in the conditional approval letter for the Final Plat that was approved by the City’s Common Council; and

WHEREAS, as a result, a 30-foot building setback was set forth by the Final Plat, recorded on July 22, 2015 in Volume 60-039B of Plats on Pages 196-197, as Document No. 5170337; and

WHEREAS, City Engineering Division and City Planning agree that a building setback reduction is appropriate for the Lots and approve of releasing 10 feet of the 30-foot building setback set forth by the Final Plat, as depicted on attached Exhibit A.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Partial Release of Platted Building Setback document, with said release areas depicted on attached Exhibit A and legally described as follows:

Lot 1 Setback Release

The North 10 feet of the South 30 feet of Lot 1, Autumn Ridge Reserve, as recorded in Volume 60-039B of Plats, on pages 196-197, as Document Number 5170337, Dane County Registry, located in the Southwest Quarter of the Northwest Quarter of Section 21, Township 07 North, Range 08 East, City of Madison, Dane County, Wisconsin.
