Fiscal Note

No fiscal Impact. Minor utility fund balance of approximately $6,200 shall be transferred from the town of Blooming Grove to the Madison Sewer Utility. Those funds shall be used for minor repairs deemed necessary to bring the sewers to normal acceptable operating condition.

Authorizing the Mayor and City Clerk to execute an Intergovernmental Agreement Relating to the Transfer of Sanitary Sewer Improvements and Service for the Regas Road and Larsen Road Areas.

Body

WHEREAS, in approximately 1966, Blooming Grove constructed a sanitary sewer main and other improvements in Regas Road (the “Regas Road Improvements”) and began providing sanitary sewer service to certain Blooming Grove properties in the area (the “Regas Road Area”), which properties the Madison Metropolitan Sewerage District (MMSD) considers to be part of the Town of Blooming Grove Regas Road Sanitary District for billing and accounting purposes; and,

 

WHEREAS, three Blooming Grove parcels in the area of Larsen Road and Meadowview Road, (the “Larsen Road Area”), are served directly by MMSD and also considered to be part of the Town of Blooming Grove Regas Road Sanitary District for billing and accounting purposes; and,

 

WHEREAS, Blooming Grove and Madison have expressed mutual interest about Madison taking over the Sewer Areas from Blooming Grove, including transferring all assets and liabilities to Madison, at which point Madison would assume ownership of the sewers and / or responsibility for service to the respective customers and continue to provide sanitary sewer service to the Blooming Grove properties presently being served by  Blooming Grove; and,

 

WHEREAS, the Madison Sewer Utility has found that the Blooming Grove sewers are in adequate condition and that assumption of these assets and liabilities and continuing service to the Blooming Grove properties connected to the Blooming Grove Sewer is in the best interests of the City.

 

NOW, THEREFORE, BE IT RESOLVED that Common Council approves the terms and conditions of the Intergovernmental Agreement Relating to the Transfer of Sanitary Sewer Improvements and Service for the Regas Road and Larsen Road Areas, attached hereto and incorporated by reference; and,

 

BE IT FURTHER RESOLVED, that the Mayor and the City Clerk are authorized to execute the Intergovernmental Agreement Relating to the Transfer of Sanitary Sewer Improvements and Service for the Regas Road and Larsen Road Areas, and any other document necessary to effectuate the transfer of services to the City of Madison as provided for in the Agreement, on a form and in a manner that has been approved by the City Attorney and the Risk Manager; and,

 

BE IT FURTHER RESOLVED, that the Common Council finds that upon transfer of the Blooming Grove Sewers, it is in the City’s best interests to provide sanitary sewer service to the town properties in accordance with the Agreement and pursuant to Madison General Ordinances Sec. 35.02(4)(b).
