Title
Authorizing the execution of a Conveyance of Rights in Land document by the City of Madison in favor of the State of Wisconsin Department of Transportation in connection with Transportation Project Plat No. 1206-07-25-4.05, Relocation Order USH 18 Dane County Mount Horeb-Madison (Cty PD - Raymond Road) reconstruction project.
Body
WHEREAS, the State of Wisconsin Department of Transportation (“WisDOT”) is currently reconstructing USH 12/18 pursuant to Transportation Project Plat No. 1206-07-25-4.05 (the “TPP”); and
WHEREAS, WisDOT requests the release of utility rights from the City of Madison (“City”) for a water main facility located on a portion of lands identified as Parcel 118 on the TPP’s Schedule of Lands and Interests Required; and
WHEREAS, the City and WisDOT agree that the release of utility rights shall be accomplished by recording a Conveyance of Rights in Land document (“Conveyance”), at no cost to either party; and
WHEREAS, The City’s Water Utility, Engineering Division, and the Office of Real Estate Services have reviewed the TPP and the Conveyance and approve of the requested release of utility rights.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the release of rights for a water main facility by the execution of a Conveyance of Rights in Land document from the City of Madison in favor of the State of Wisconsin Department of Transportation, at no cost to either party, for utility interests identified in Transportation Project Plat No. 1206-07-25, more particularly described on Exhibit A and depicted on Exhibit B.
BE IT STILL FURTHER RESOLVED, that the Mayor and Clerk are authorized to sign any and all documents and legal instruments required to complete the request contemplated in this resolution.
