Title
Authorizing the acceptance of a Quit Claim Deed from Eagle Aerie Holding Company, Inc. to the City of Madison for the dedication of a property located at 762 Holy Cross Way.
Body
WHEREAS, Eagle Aerie Holding Company, Inc. (the “Owner”) is the owner of property located at 762 Holy Cross Way in the City of Madison, Dane County, Wisconsin (the “Property”), legally described on attached Exhibit A; and
WHEREAS, the Property is a 338 square foot private outlot in the Eagle Crest Subdivsion, platted with the purpose of providing street frontage to the adjacent property lying outside plat boundary; and
WHEREAS, the Property is of no value to the Owner because of its size and shape; therefore the Owner desires to dedicate the Property to the City of Madison (“City”) at no cost to the City; and
WHEREAS, the City Engineering Division has reviewed the request and agrees to accept the dedication of the Property for right-of-way purposes; thereby perpetuating the street frontage use and right of access to the adjacent property.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the acceptance of a Quit Claim Deed from Eagle Aerie Holding Company, Inc. for the conveyance of property located at 762 Holy Cross Way, as legally described on attached Exhibit A.
BE IT FURTHER RESOLVED, that the Mayor and Clerk are authorized to sign any and all documents and legal instruments required to complete the transaction contemplated in this resolution.
