To petition the State of Wisconsin Commissioner of Railroads to make a determination on construction of a new roadway and pedestrian crossing of the rail corridor at City View Drive and make a determination of the crossing protection required.

Preamble

 

The City Engineering 2016 Capital Budget provides for construction of the extension of City View Drive from its southern terminus to Lien Road.  The project will require the construction of an at grade railroad crossing at the intersection of City View Drive and the Wisconsin Department of Transportation railroad corridor.  The improvements at this location are in the interest of public safety and convenience. 

 

State Statutes 195.28 and 195.29 pertaining to railroad / highway crossings and their protection require the City to petition the State of Wisconsin Office of Commissioner of Railroads to investigate, hold a public hearing and make a determination in these matters regarding public convenience and safety, 

 

NOW, THEREFORE BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to petition the State of Wisconsin Commissioner of Railroads to make a determination on construction of a new roadway and pedestrian crossing of the rail corridor at City View Drive and make a determination of the crossing protection required;

 

BE IT FURTHER RESOLVED that the Mayor shall authorize the City Attorney or other City staff as may be necessary to present the City’s interests at any hearing before the Commissioner of Railroads.
