Title

Authorizing the Mayor and the City Clerk to execute a Release of Water Main Easement and to grant a Water Main Easement for existing facilities over a portion of the property located at 1701 Wright Street.

Body

WHEREAS, the County of Dane is the owner (the “Owner”), and Madison Area Technical College District is the lessee (the “Lessee”) of the property located at 1701 Wright Street (the “Property”); and

WHEREAS, the Lessee wishes to construct an addition (the “Improvement”) to the Lessee’s building (the “Building”) located on said property; and

WHEREAS, during a recent City of Madison (the “City”) site plan review for said Improvement, the City Engineering Division noted that there was no record of a recorded easement for existing water main facilities (the “Facilities”) located within the Property; and

WHEREAS, the Owner and the Lessee desire to grant, and the City desires to accept, a 20-foot wide water main easement for said Facilities, at no cost to the City; and

WHEREAS, staff from the City of Madison Engineering Division and Office of Real Estate Services have reviewed and approve the acceptance of a water main easement for the existing Facilities; and

WHEREAS, the Owner also desires to release a Water Main Easement located within the Property in which there are no existing water main facilities.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Release of Water Main Easement, legally described on attached Exhibit A-1 and depicted on attached Exhibit B-1, and to grant a Water Main Easement for existing facilities over a portion of the property located at 1701 Wright Street, legally described on attached Exhibit A-2 and depicted on attached Exhibit B-2.
