DRAFTER'S ANALYSIS: This winter, there have been complaints that private property owners are depositing snow and ice on City bike paths. Bike paths are heavily used components of the City’s transportation infrastructure and are cleared of snow and ice by the City. This ordinance specifically adds bike paths to the list of properties upon which one cannot deposit snow or ice. Currently that list includes sidewalks, roadways or streets, and the non-adjacent private property of another. Bike paths should be afforded the same protections as roadways and streets for the purposes of this ordinance. By amending this ordinance to specifically include bike paths, the City will be recognizing that bike paths should be entitled to the same level of protection as other means of transportation. In addition, this amendment will allow the City to take enforcement action against persons currently depositing snow and ice on the City bike paths.

The Common Council of the City of Madison do hereby ordain as follows:
Subsection (2) of Section 10.23 entitled “Obstruction of Streets and Sidewalks” of the Madison General Ordinances is amended to read as follows: “(2) Any person depositing snow or ice from private property upon any sidewalk, roadway or street, bike path or upon the non-adjacent private property of another without consent, or causing or ordering the same to be done shall be subject to a fine of not less than fifty dollars ($50) nor more than two hundred dollars ($200).
