Authorizing the execution of an Underground Telecommunications Line Easement to Wisconsin Bell, Inc. d/b/a AT&T Wisconsin across a portion of Cypress Spray Park, located at 902 Magnolia Lane.
Body
WHEREAS, the City Parks Division has constructed a public spray park facility called the Cypress Spray Park (the “Spray Park”), located on 902 Magnolia Lane; and

WHEREAS, Wisconsin Bell, Inc. d/b/a AT&T Wisconsin (“AT&T”) installed an underground telecommunication line within the same easement area as an existing Madison Gas and Electric underground electric line, that serves the Spray Park facility; and

WHEREAS, AT&T was contacted about the underground telecommunication line and therefore have requested an underground telecommunication line easement, across a portion of the Spray Park, for their existing facilities; and

WHEREAS, City of Madison Parks Division and Office of Real Estate Services staff has reviewed and approve of the granting of said easement.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Telecommunication Line Easement to Wisconsin Bell, Inc. d/b/a AT&T Wisconsin across a portion of the Cypress Spray Park property, legally described as follows:

A strip of land, ten (10) feet in width, located in part of Lot 157, Second Addition to Burr Oaks, lying in part of the Southeast Quarter of the Northwest Quarter of Section 35, Town 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, being more particularly described as follows:

Commencing at the Southeast corner of said Lot 157; thence on an assumed bearing along the West right-of-way line of Cypress Way, North 00 degrees 57 minutes 35 seconds East a distance of 15.00 feet to the point of beginning; thence North 87 degrees 12 minutes 31 seconds West a distance of 149.96 feet to the West line of the previously described parcel; thence alon...
