Title
Authorizing the Common Council to accept ownership from Bay Creek Neighborhood Association of a neighborhood entrance sign to be located in the public right-of-way at the northwest corner of Lake Court and W. Olin Avenue.
Body
WHEREAS, the Bay Creek Neighborhood Association (the "Association") has requested permission to install a neighborhood entrance sign within the public right-of-way at the northwest corner of Lake Court and W. Olin Avenue.  A location map is included as Exhibit A and a location detail is included as Exhibit B.  An artist's rendering of the sign is included as Exhibit C and an actual photo of the sign materials is included as Exhibit D; and
 
WHEREAS, the Association will transfer ownership of the neighborhood entrance sign to the City after it has been installed, in exchange for the ongoing maintenance of the sign by the Association; and
 
WHEREAS, City staff have reviewed this request and approved it with conditions.
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison accepts ownership from the Bay Creek Neighborhood Association of a neighborhood entrance sign to be located in the public right-of-way at the northwest corner of Lake Court and W. Olin Avenue, as shown and illustrated on the attached Exhibits A, B, C and D; subject to the following conditions:
 
1.      The Association shall locate the neighborhood entrance sign within a specific area, as approved by the City Traffic Engineer and City Engineering Division.
 
2.      The Association shall install and maintain the neighborhood entrance sign.  
 
3.      The Association shall be responsible for locating all underground utility services in the area where the sign is to be placed, and shall contact Diggers Hotline prior to any excavation or construction activities.
 
4.      The Association shall comply with all Madison General Ordinances regarding the construction and installation of the sign within public right-of-way, including any and all applicable City of Madison permits for excavation and installation, if applicable.
 
5.      The Association shall agree that the City shall not be held responsible for any damage to the neighborhood entrance sign that may be caused by the City, its employees, contractors or others.
 
6.      The City may remove the neighborhood entrance sign if not properly maintained, including applicable vehicular vision clearances, by giving the Association sixty (60) days written notice prior to removal.  
 
The City may remove the neighborhood entrance sign if the area occupied by said items is required for transportation or other public purposes, by giving the Association sixty (60) days written notice prior to removal.  Transportation purposes include, without limitation because of enumeration, public alleys, streets, highways, bike paths, sidewalks, and facilities for the development, improvement and use of public mass transportation systems.
