AMENDED THIRD ALTERNATE  Amending Sections 12.915(8)(a) and (b) and Section 11.06(3)(r) of the Madison General Ordinances to prohibit taxicabs waiting for passengers on State Street and permits them to provide service on State Street between the hours of 10:00 p.m. and 4:00 a.m.

DRAFTER'S ANALYSIS:  This ordinance repeals language allowing taxicabs to enter State Street and wait in designated loading areas.  It permits taxicabs to provide service to prospective fares on State Street without restrictions other than the traffic code between the hours of 10:00 p.m. and 4:00 a.m.  This ordinance will also clarify that hotel shuttle vehicles are not public passenger vehicles.  The ordinance expands the one block limitation on taxis travelling on State Street during the hours of 4:00 a.m. to 10:00 p.m., to allow them to leave State Street on the next block that is in the direction of their destination (including a destination on State Street).  The ordinance has a delayed effective date for FTA concurrence.

The Common Council of the City of Madison do hereby ordain as follows:
      1.      Subdivision (a) of Subsection (8) entitled "Public Passenger Vehicle Regulations" of Section 12.915 entitled "Traffic on State Street Restricted" of the Madison General Ordinances is amended to read as follows:
"(a)      Taxicabs and other public passenger vehicles shall enter the area for the sole purpose of receiving or discharging passengers specifically requesting service to properties directly adjacent to State Street.  Between the hours of 7:00 p.m. and 5:00 a.m. during Central Standard Time, and between the hours of 9:00 p.m. and 5:00 a .m. during Daylight Savings Time, these vehicles may drive onto State Street to wait in designated loading zones for prospective fares and during the hours specified these vehicles are subject to the limitation regarding idling as provided in subsection (7)(e)
Between 10:00 p.m. and 4:00 a.m.:  Between 10:00 p.m. and 4:00 a.m., taxicabs and other public passenger vehicles may provide service on State Street without being subject to the restrictions in subsection (8)(b) of this ordinance."
      2.      Subdivision (b) of Subsection (8) entitled "Public Passenger Vehicle Regulations" of Section 12.915 entitled "Traffic on State Street Restricted" of the Madison General Ordinances is amended to read as follows:
"(b)      Between 4:00 a.m. and 10:00 p.m.:  Between 4:00 a.m. and 10:00 p.m., Iit shall be unlawful for taxicabs and other public passenger vehicles to enter and exit State Street other than via the cross street nearest to their immediate destination or by a route specified by the Traffic Engineering Division of the Department of Transportation.  Taxicabs and other public passenger vehicles shall enter the area for the sole purpose of receiving or discharging passengers specifically requesting service to properties directly adjacent to State Street, provided, however, that while picking up or depositing a passenger on the one block of State Street they are allowed to use, taxicabs and other public passenger vehicles may pick up any other passengers on that block that hail the cab."
3.       Subdivision (r) of Subsection (3) entitled "Definitions" of Section 11.06 entitled "Licensing and Regulating Public Passenger Vehicles, for Hire" of the Madison General Ordinances is amended to read as follows:
"(r)      "Public passenger vehicle" shall mean any self-propelled vehicle, pedal-cab, or horse-drawn vehicle which is used for the transportation of passengers for hire, excepting: 1) those operated on fixed routes pursuant to authority granted by the City, State or Federal Government; 2) such vehicles as are rented to be driven by the renter or her/his agent, commonly known as rent-a-cars; 3) vehicles operated solely as funeral cars; 4) carpools; and 5) amphibious motor vehicles properly registered and licensed by the Wisconsin Department of Transportation as motor buses and operating on the highway upon routes between lake access points; and 6) hotel shuttle vehicles."
4.      This ordinance shall take effect fourteen (14) days after the City receives confirmation from the Federal Transit Administration (FTA) of its concurrence in this minor change in use of the fixed guideway on State Street.  The City Attorney will report to the Council as soon as such concurrence is received.  The City Attorney will also report to the Council if such concurrence is not received within sixty (60) days of passage.
