Fiscal Note
The initial year cost of these software support and maintenance agreements is included and available in the adopted ERP project budget. Future year costs will be incorporated in the annual operating budget beginning in 2011.

Body
WHEREAS, in Resolution No. RES-09-00976, adopted on December 15, 2009, the Common Council approved a contract with Tyler Technologies, Inc. (“Tyler”) for an Enterprise Resource Planning (“ERP”) financial management software system; and

WHEREAS, the solution proposed by Tyler to meet the City’s needs includes the use of software systems supplied by third party software vendors Mid-America Consulting Group, Inc. and SymPro, Inc., the price of which is included in the cost of the Tyler contract; and

WHEREAS, the third party software is being installed by Tyler and integrated with Tyler’s “MUNIS” software to form the complete ERP system as part of the City’s implementation contract with Tyler; and

WHEREAS, after the third party software is installed, the City will require annual support and maintenance services and those services will be provided directly by these other software companies (because the software is proprietary and can only be updated and maintained by the company that owns the license to the software); and

WHEREAS, maintenance on the third party software will be provided by Tyler the first year, and funding for year 1 was approved in RES-09-00976, and by the third parties thereafter; and

WHEREAS, Mid-America Consulting Group, Inc. has offered a ten year contract commitment as follows:
ProviderGateway Software:
Year 1 annual fee of $7,500 (paid through Tyler)
Years 2-5: not more than 5% increase (paid to Mid-America)
Years 6-10: not more than 7.5% increase (paid to Mid-America)
