SUBSTITUTE Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM on Pleasant View Road, Valley View Road, County Trunk Highway M, Mineral Point Road and Prairie Hill Road. (9th AD)

PREAMBLE
The City of Madison has a project to improve Valley View Road, Pleasant View Road, County Trunk Highway M, Mineral Point Road and Prairie Hill Road. The planned improvements include reconstruction of the streets, storm sewer, water main, sanitary sewer and lighting. Construction is planned to take place during the 2010 and 2011 construction seasons.
Portions of the construction of this project cannot take place during the normal working hours of 7:00 AM to 7:00 PM because of the high traffic volume on the roadway. Night work will be required to avoid traffic backups and excessive disruption to normal travel patterns.
The proposed activities that will occur during the hours of 7:00 PM to 7:00 AM are general construction operations including sawing asphalt; removing asphalt, base course and earth; placing fill, base course and asphalt; installing concrete barriers, performing traffic lane switches and installing new overhead sign structures.
Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances. Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities, with associated noise impacts, outside of the hours of 7:00 AM to 7:00 PM with the passage of a resolution.
NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on Valley View Road, Pleasant View Road, County Trunk Highway M, Mineral Point Road and Prairie Hill Road are hereby approved in accordance with section 24.08(3) of the Madison General Ordinances, and
BE IT FURTHER RESOLVED, that the construction activities outside of the hours of 7:00 AM to 7:00 PM are limited to those activities identified in this resolution, and
BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on December 31, 2011.
BE IT FURTHER RESOLVED, the construction activities allowed on this project between the hours of 7:00 PM to 7:00 AM shall be limited to those identified on the attachment document Construction Noise City of MSN.pdf.
