Fiscal Note
Currently, the Clerk's Office issues approximately 2,000 Operator licenses annually at $35 each, which yields an estimated $70,000 annually in General Fund revenues.  An increase in the license fee of $40, from $35 to $75 as proposed, is anticipated to yield total General Fund revenues in 2010 of $150,000, a net revenue increase of $80,000.  In 2011, additional Operator applicants will receive a license for the remainder of 2011 at a cost of $40 each.  The Clerk's Office estimates that there may be 1,200 such licenses issued in the second year of the new licensing cycle, yielding total General Fund revenues of approximately $48,000.  Subsequently, the City might expect a continuing cycle of $150,000 in the first year of the two-year licensing term, followed by an estimated $48,000 in each of the second year licensing periods.  Thus, in 2010, City General Fund revenues are anticipated to increase by $80,000 (these revenues are included in the 2010 Executive Operating Budget); however, in 2011 (and each second year thereafter), City budgets will need to recognize a "decrease" in revenues of an estimated $102,000 ($150,000 total in the first year minus $48,000 in the second year).

DRAFTER'S ANALYSIS:  This proposal changes the license period of an operator's (bartender's) license from one year to two years.  It raises the license fee from $35.00 a year to $75.00 for two years.  Those who obtain their first operator's license in the second year of the license period will pay a license fee of $40.00.

The Common Council of the City of Madison do hereby ordain as follows:
      Subdivision (e) of Subsection (4) entitled "Fees" of Section 38.08 entitled "Fermented Malt Beverages" of the Madison General Ordinances is amended to read as follows:
"(e)      The fee for an operator's license shall be thirty-five dollars ($35.00) per year.  Beginning on July 1, 2010,  the fee for an operator's license shall be seventy-five dollars ($75.00) for two years.  Operator's licenses shall expire on June 30 of  the even numbered year.  A person who applies for an operator's license after June 30 of an odd numbered year shall pay a license fee of forty dollars ($40.00) for the remaining license period.  Renewal licenses shall be obtained on or before June 30 of eachthe even numbered year or be subject to a late filing fee of 15% of the license fee or a minimum of $3.00, whichever is greater. Payment of the late filing fee shall not relieve any person from any other penalties prescribed in this chapter for failure to possess or obtain a license."
