Title
To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE certain Mall/Concourse vending licenses from 1:00 p.m., September 4, 2009 to 11:59 p.m., September 6, 2009 in the areas specified below for the benefit of Madison Festivals Inc., so that TASTE OF MADISON may occur.
Body
WHEREAS, Section 9.13 (6) of the Madison General Ordinances and the regulations adopted therein control street vending on the State Street Mall/Capitol Concourse area; and

WHEREAS, Section 9.13 (6)(k)1 allows the Common Council to suspend specifically enumerated vending ordinances or regulations and establish alternate rules and procedures during a special event; and

WHEREAS, Section 9.13(6)(k)3. authorizes the Common Council to invalidate street vending licenses, Mall-Concourse Vending Licenses and sidewalk cafe licenses within the perimeter of a special event in order to encourage the integrity, comprehensiveness and success of a special event; and

WHEREAS, the TASTE OF MADISON is such a special event; and

WHEREAS, Madison Festivals Inc. , as sponsor of the special event, agrees to obtain a Street Use Permit for the setup and conduct of this event from 6:00p.m. September 4th to 11:59 p.m. on September 6th, 2009, and agrees to comply with the conditions of the permit, including but not limited to any conditions placed on the permit by the Street Use Staff Team; and

WHEREAS, Madison Festivals Inc. , wishes to insure the integrity, comprehensiveness and success of TASTE OF MADISON by retaining control over the vending of both goods and food, and has demonstrated that special conditions exist which warrant such action by the Common Council; and

WHEREAS, the sponsors agree to comply with all recommendations of the Street Use Staff Team and the Vending Coordinator concerning the location of vending sites and use of electricity; and

WHEREAS, street vending or Mall/Concourse vending licenses will be invalidated at this location not more than ten times in the year 2009, including this event:

NOW, THEREFORE, BE IT RESOLVED, that the Common Council hereby SUSPENDS the vending restrictions relating to handcrafted goods and personally prepared food set forth in 9.13(6)b of the Madison General Ordinances for the participants in this event on the above-mentioned dates and times on the following portions of streets and sidewalks:

Capitol Concourse - comprised of the 10 blocks of N. And S. Pinckney, the 10 blocks of N. And S. Carroll St., the 10 blocks of E. And W. Mifflin St. and the 10 blocks of E. And W. Main St.
100 block of E. and W. Washington Ave.
100 block of Wisconsin Ave. and 100 Martin Luther King, Jr. Blvd.
100 block of State St. and King St.
100 block of E. and W. Mifflin
100 block of E. and W. Main St.
100 block of N. and S. Carroll
100 block of N. and S. Hamilton
100 block of N. and S. Pinckney

BE IT FURTHER RESOLVED that any vending taking place within above-described streets and sidewalks from 1:00p.m. September 4th to 11:59 p.m. on September 4th, 2009 shall be limited to food, beverages, goods, and promotional items (such as t-shirts, posters, and souvenirs), which are related to the purpose of the event;

BE IT FINALLY RESOLVED that the Common Council hereby INVALIDATES all Mall/Concourse vending licenses, with the exception of sidewalk cafe licenses, within above-described streets and sidewalks from 1:00p.m. September 4thto 11:59 p.m. on September 4th,2009.
