Accepting a 20-foot wide Public Sanitary Sewer Easement from McDonald's Corporation across property located at 3002 Darbo Drive.
Body
WHEREAS, the property located at 3002 Darbo, formerly addressed as 3051 E Washington Avenue, contains an existing Sanitary Sewer constructed circa 1950 by the Town of Blooming Grove; and
 
WHEREAS, a condition of receiving a Conditional Use permit requires the Owner to convey a 20-foot wide easement for sanitary sewer purposes to the City of Madison; and
 
WHEREAS the Owner, McDonald's Missoula Mac, Inc, has offered a Public Sanitary Sewer Easement to the city of Madison at no cost; and
 
WHEREAS, City of Madison engineering division staff have reviewed and recommend the acceptance of this Public Sanitary Sewer Easement.
 
NOW, THEREFORE, BE IT RESOLVED, that the City of Madison is hereby authorized to accept from McDonald's Missoula, Inc., at no cost to the CIty of Madison, a 20-foot wide Public Sanitary Sewer Easement, centered along the existing sanitary sewer line, across property described as follows:
 
A 20 foot wide easement for sanitary sewer purposes located in the Northwest Quarter of the Northwest Quarter of Section 5, Town 7 North, Range 10 East, City of Madison, Dane County, Wisconsin, whose centerline is described as follows:
Commencing at the Northwest corner of said Section 5; thence South 89°04'27" East along the North line of the Northwest Quarter of Section 5, 1040.40 feet; thence South, 796.55 feet; thence East, 106.41 feet to the most Westerly corner of Lot 1 of Certified Survey Map 1804; thence South 49°09'39" East (recorded as South 48°37' East and South 48°43' East) along the Southwesterly line of Lot 1 of Certified Survey Map 1804, 154.83 feet to the point of beginning of the line to be described; thence South 40°15'17" West, 25.00 feet to the end of the line being described.
