Amending Sec. 24.08(3)(d) of the Madison General Ordinances to clarify certain exemptions to the Noise Control Ordinance.

DRAFTER'S ANALYSIS: This ordinance does not effectuate a substantive change in the City’s noise restrictions. Rather, this ordinance merely clarifies the existing exemption under Sec. 24.08(3)(d) to the noise control ordinance for “[o]utdoor gatherings, public dances, shows, and sporting and entertainment events for which a permit or license is required and obtained pursuant to Madison General Ordinances.” As applied, this language exempts certain events, such as events in parks where a park event amplification permit is required or events in the public right-of-way where a street use permit is required, from the noise restrictions set forth in Sec. 24.08. Noise controls on such events are set by those other permits and approvals. However, there has been some confusion by the public about these overlapping noise regulations and how such events may exceed the general noise regulations of Sec. 24.08. Hence, to assist in a better understanding of the City’s noise regulations, this ordinance amends the existing exception language to clearly state that these types of events are exempt from the noise restrictions of Sec. 24.08.

The Common Council of the City of Madison do hereby ordain as follows:
Subdivision (d) of Subsection (3) entitled “Exemptions” of Section 24.08 entitled “Noise Control Regulation” of the Madison General Ordinances is amended to read as follows:
“(d) Outdoor gatherings, public dances, shows, and sporting and entertainment events for which a permit or license is required and obtained pursuant to Madison General Ordinances, such as park event amplification permit under Sec. 8.29 or a street use permit under Section 10.056.”
