Title
Accepting a Permanent Public Easement for sidewalk purposes from Park East, LLC across property located at 3502 Dennett Drive.
Body
WHEREAS, the Owner, Park East, LLC was required to construct public sidewalk under Private Contract No. 2110/City Engineering Division Project No. 53B2110; and
WHEREAS, the Owner agreed to construct the sidewalk, a portion of which is on the Owner's property, and has offered an Easement to the City at no cost to the City; and
WHEREAS, the City of Madison Engineering Division has reviewed and recommends that said Easement be accepted.
NOW, THEREFORE, BE IT RESOLVED, that the Common council of the City of Madison hereby accepts a Permanent Easement for Sidewalk Purposes, at no cost, from Park East, LLC across the parcel as described below:
Being a sidewalk easement in part of Lot 2 and Lot 3 of the Walterscheit Plat, lying in the Northeast 1/4 of the Northeast 1/4 of Section 08, T07N, R10E, City of Madison, Dane County, Wisconsin, more fully described as follows:
Commencing at the most Westerly corner of Lot 1 of the Walterscheit Plat; Thence S 34º53'43" E, 48.24 feet, along the Northeasterly right-of-way of Atwood Avenue, to the Point of Beginning of this description;
Thence continuing along said right-of-way, S34º53'43" E, 56.55 feet.
Thence along a curve to the left, having a radius of 15.00 feet and a chord that bears S 61º19'56" E, 13.37 feet;
Thence N 54º05'35" W, 12.11 feet;
Thence along a curve to the left, having a radius of 1,411.00 feet and a chord that bears N 36º52'27" W, 57.21 feet, to the Point of Beginning of this description.
Said described easement contains 91 square feet.
