Title
Amending Section 23.05(4)(b) and 23.05(1) of the Madison General Ordinances to prohibit smoking within 25 feet of the downtown public library and create a definition of outdoor air intake.

DRAFTER'S ANALYSIS: Under Resolution 08-00109 new City buildings should attempt to obtain Green Building Certification. For the new downtown library to receive Green certification under the Leadership in Energy and Environmental Design (LEED), the City must designate areas within 25 feet of all entrances, outdoor air intakes or operable window as smokefree.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (b) of Subsection (4) entitled "Prohibition of Smoking in Outdoor Areas" of Section 23.05 entitled "Smoking Prohibited In Certain Areas" of the Madison General Ordinances is amended to read as follows:
"(b) Within twenty-five (25) feet of any entrance, outdoor air intake or operable window Outside the Bernard Schwab Building of the Madison Downtown Public Library, known as the Central Library, between the front entrance of the library and the public sidewalks on the Fairchild Street and the Mifflin Street sides of the building including but not limited to the entrance steps, the planters, and all cement areas adjacent to the building."
2. Subsection (1) entitled "Definitions" of Section 23.05 entitled "Smoking Prohibited in Certain Areas" of the Madison General Ordinances is amended by creating therein the following:
""Outdoor air intake" means an opening or inlet through a wall louver or vent by which outside air is brought into an air-conditioning system or into a boiler room, also, known as a fresh-air intake."
