Amending Sec. 3.27(1) of the Madison General Ordinances to eliminate U.S. citizenship requirement for volunteer members of boards, commissions and committees.

DRAFTER'S ANALYSIS:  This ordinance eliminates U.S. citizenship requirement for volunteer members of boards, commissions and committees.  U.S. citizenship/lawful entry/lawful work status for paid employees is required as a matter of federal labor laws.  This amendment will not affect the City's responsibility to comply with federal labor laws.

      Subsection (1) entitled "Citizenship" of Section 3.27 entitled "Qualifications--City Officers, Members of Commissions, and Employees" of the Madison General Ordinances is amended to read as follows:  
"(1)      Citizenship. No person shall be eligible for election as an officer of the City of Madison unless he or she shall be at the time of his or her election a citizen of the United States., nor shall any person be eligible for appointment or employment to any position as a department head, employee or member of a board or commission unless he or she shall be at the time of his or her appointment or employment a citizen of the United States; provided, however, that the citizenship requirement for a person other than an officer of the City of Madison may be waived by the Mayor if the City Attorney certifies in writing that the position to which the person is being considered for appointment or employment is not one in which lack of United States citizenship could, in any circumstances, be a bar to full and conscientious performance of duty or present a conflict of interest."
