AMENDED SUBSTITUTE Amending Section 35.01 and creating Sec. 35.03 of the Madison General Ordinances to formalize the appointment procedure for the City’s appointees to the Madison Metropolitan Sewerage District.

DRAFTER'S ANALYSIS: In 2015, largely at the City’s urging, the State altered the governance structure of the Madison Metropolitan Sewerage District, shifting the appointment of District Commissioners from the Dane County Board to the municipalities who make up the District. The City, making up the largest portion of the District’s customer base, has, by statute, five appointments to the nine-member Commission. Under Sec. 200.09(1)(b), the Mayor is authorized to make these appointments. This ordinance, in addition to making a clerical edit to the definition of District in Sec. 35.01, would require that the Mayor’s appointments to the Commission under this statute be confirmed by the Common Council and that one of the appointments be an elected official.
This Substitute makes two of the City appointees Madison alderpersons, who serve ex officio (that is, by reason of being elected and would no longer be members if they are not elected) and clarifies that they would be voting members.
This Amended Substitute changes the number of alders from two to one or two appointed alders.

The Common Council of the City of Madison do hereby ordain as follows:
1. Section 35.01 entitled “Definitions” of the Madison General Ordinances is amended to read as follows:
“District shall mean the Madison Metropolitan Sewerage District (MMSD), a metropolitan sewerage district governed by a commission with such powers as set forth in subch. I of ch. 200, Wis. Stats., as amended from time to time.”
