Accepting a donation of a parcel of land, from B & B Family Limited Partnership, for assemblage purposes to the Starkweather Creek Open Space located at 3614 Milwaukee Street.
Body
WHEREAS, the B&B Family Limited Partnership and Robert Blettner donated a large tract of wetlands to the City of Madison in 2006, for expansion of the Starkweather Creek Open Space, as shown on Exhibit A; and
 
WHEREAS, the B&B Family Limited Partnership maintained ownership of the parcel of land, extending from Milwaukee Street on the south to the now City-owned parcel on the north, for possible sale to an adjacent owner; and
 
WHEREAS, the B&B Family Limited Partnership was unable to consummate the sale and have offered to donate the parcel to the City of Madison for assemblage to the Starkweather Creek Open Space; and
 
WHEREAS, Park Division staff have reviewed and recommend acceptance of this donation of land; and
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison authorizes the acceptance of a parcel of land from B&B Family Limited Partnership for assemblage purposes to the Starkweather Creek Open Space, as described and depicted on attached Exhibit A, on the following conditions:
 
1.      The City shall obtain a satisfactory title commitment for the parcel to be donated.
 
2.      The B&B Family Limited Partnership shall donate the parcel to the City of Madison at no cost.
 
BE IT FURTHER RESOLVED, that the Mayor and Clerk are authorized to sign any and all documents related to this transaction, that are necessary to complete this transaction.
