Title
Rescinding the relocation order approved by RES-17-00546. (Adjacent to 6 & 15 ADs).
Body
WHEREAS, on July 11, 2017 the Common Council adopted RES-17-00546 (File ID No. 47386), a resolution entitled “Determining a Public Purpose and Necessity and adopting a Relocation Order for the acquisition of land interests required for the construction and maintenance of the Starkweather Creek Coagulant Treatment System and associated facilities for urban water quality improvement”; and
WHEREAS, this resolution in part authorized creation of a relocation order and the acquisition of land interests required to construct the Starkweather Coagulant Treatment System, which system was designed to reduce urban phosphorous discharges; and
WHERAS, in the intervening time, funding priorities for the Stormwater Utility have shifted toward flood relief projects; and
WHEREAS, the City of Madison has more cost-effective phosphorous reduction options available through the YAHARA WINS adaptive management project and will no longer be proceeding with this project.
NOW, THEREFORE, BE IT RESOLVED, that the relocation order authorized by RES-17-00546 is hereby rescinded ending the Stormwater Utility’s ongoing interest in the acquisition of portions of the parcel located in part of the NE ¼ and SE ¼ of the NE ¼ of Section 5 and the NW ¼ of the NW ¼ of Section 4, T7N, R10E in the Town of Blooming Grove as described in the original relocation order.
BE IT FURTHER RESOLVED that the City Engineer and the Manager of the Office of Real Estate Services are authorized to execute any documents necessary to effectuate the withdrawal of this relocation order and clear title for the underlying property.
