Authorizing the Mayor and City Clerk to execute a quit claim deed to 2501 Stoughton Rd LLC to correct the legal description and boundary lines of the property at 2501 S. Stoughton Rd. (16th A.D.)
Body
WHEREAS, The City of Madison (the “City”) was the former owner of a parcel of land addressed as 2501 S. Stoughton Road (the “Larger Parcel”) for a period of time beginning in 1975 until the City conveyed the Larger Parcel in 1991; and
WHEREAS, in a survey of the Larger Parcel dated October 8, 1975, which survey is attached here as Exhibit A, it was discovered that a portion of a former building encroached onto land south of the boundary of the Larger Parcel; and
WHEREAS, the area into which the former building encroached (the “Subject Property”), totaling approximately 106 square feet, was conveyed to the City by a Warranty Deed recorded in the Office of the Dane County Register of Deeds on March 26, 1976 as Document No. 1462440; and
WHEREAS, in 1991 the City quit claimed the Larger Parcel to a new owner by a Quit Claim Deed recorded in the Office of the Dane County Register of Deeds on October 30, 1991 as Document No. 2298614, but erroneously omitted the Subject Property from the legal description in the Quit Claim Deed; and
WHEREAS, 2501 Stoughton Rd LLC is the current owner in fee simple of the Larger Parcel, and recently applied for a land use approval from the City for a demo permit and a conditional use pertaining to the construction of a new building on the Larger Parcel; and
WHEREAS, 2501 Stoughton Rd LLC must work with the City to correct this error in the prior legal description, thereby correcting the boundary of the Larger Parcel, as a condition of approval for the land use application.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to execute a quit claim deed prepared by the Office of Real Estate Services to convey the Subject Property to 2501 Stoughton Rd LLC, the...
