Body
WHEREAS, Jeffy Trail was dedicated to the public per Second Addition to Hawks Creek as recorded in Volume 59-033A of Plats, on pages 166-167, as Document Number 4313581, Dane County Registry; and,

WHEREAS, this portion of Jeffy Trail public right-of-way was never improved with the construction of a public street by the city of Madison; and,

WHEREAS, the city of Madison Common Council adopted Resolution 12-00875 on November 27, 2012 authorizing the execution of an Purchase and Sale Agreement between the City of Madison and the Madison Audubon Society, Inc. for the purchase of a 9.48-acre improved residential parcel located at 7960 Raymond Road to facilitate the proposed Wolfe Addition to Hawks Creek; and,

WHEREAS, the city of Madison Common Council is scheduled to approve the preliminary and final plat of Wolfe Addition to Hawks Creek per File ID No. 29417; and,

WHEREAS, the proposed Wolfe Addition to Hawks Creek changes the horizontal alignment and dedicates necessary new right-of-way for future Jeffy Trail; and,

WHEREAS, the portion of Jeffy Trail must be vacated prior to the recording of the Wolfe Addition to Hawks Creek; and,

NOW THEREFORE BE IT RESOLVED, that the City Of Madison declares that it is in the public’s interest to discontinue and vacate Jeffy Trail as depicted on attached Exhibit A attached hereto and made part of this resolution; and,

BE IT FURTHER RESOLVED, following Common Council adoption, the City Clerk shall record the street vacation resolution and exhibits with the Dane County Register of Deeds; and,

BE IT FINALLY RESOLVED, upon City Clerk recording a certified copy of the final resolution with the Dane County Register of Deeds, the vacated lands shall be replatted pe...
