The 2020 Adopted Operating Budget included $51,853 contract funding that was awarded to Independent Living, Inc. for housing modifications for elderly and disabled individuals. The proposed resolution authorizes transitioning the contract from Independent Living, Inc. to Marquardt Home and Community Based Services, Inc. The original contract has $37,092 of remaining expense authority, which will transfer to Marquardt Home and Community Based Services, Inc. to provide the remainder of contracted services in 2020. Funding for this contract was included in purchased services in the Community Development Division-Affordable Housing service. No additional City appropriation is required.

Authorizing a change to legal documents entered into between the City of Madison and Independent Living, Inc. to reflect the transition of the community-based program funded by the City to another agency, Marquardt Home and Community Based Services, Inc.

Background:
The City of Madison Community Development Division has been notified that Independent Living, Inc. has signed an agreement to transition certain community programs operated by Independent Living to Marquardt Home and Community Based Services, Inc. This program transition is the result of financial difficulties experienced by Independent Living since December 2019. Independent Living determined that, in order to secure these programs, the operations should be transferred to a different agency. As a result of the transition agreement, the executive director of Independent Living, Inc. approved the transfer of the Home Modification program to Marquardt. Authorized by the 2020 City of Madison Operating Budget, adopted by Common Council on November 12, 2019 (Legistar #57501), Independent Living, Inc. received an allocation of $51,853 to fund the operation of the Home Modification program. Common Council must authorize the execution of a new Purchase of Service contract to Marquardt Home and Community Based Services, Inc. for the amount remaining in 2020 of $37,092, to transfer authorization of the funds and services to the new entity.
Action:
WHEREAS, the Common Council previously authorized in the approved 2020 City of Madison Operating Budget an allocation of $51,853 to Independent Living, Inc. for housing modifications for elderly and disabled individuals; and,
WHEREAS, Independent Living, Inc. has entered into a Program Transition Agreement whereby Marquardt Home and Community Based Services, Inc. has agreed to operate three of Independent Living, Inc.’s community-based programs, including the Home Modification program funded with Community Development Block Grant funds provided by the City; and,
WHEREAS, the Home Modification program has $37,092 of unallocated expenses in 2020 Operating Budget that will transfer to Marquardt Home and Community Based Services, Inc; and,
WHEREAS, this change to the program’s operator will not result in a disruption of services or a staffing change, is primarily administrative in nature, and does not alter the scope of the program previously approved by the Community Development Block Grant Committee or Common Council;
NOW, THEREFORE, BE IT RESOLVED, that the name Marquardt Home and Community Based Services, Inc. will replace Independent Living, Inc. in the authorized 2020 City of Madison Operating Budget and executed Purchase of Service contacts with the City of Madison; and,
BE IT FURTHER RESOLVED, that the Mayor and the City Clerk are hereby authorized to execute, deliver, publish, file and record any additional documents, instruments, notices and records, and take such other actions as shall be necessary or desirable, to accomplish the purposes of this Resolution and to comply with and perform the obligations of the City hereunder.
