Amending Sec. 38.05(12) of the Madison General Ordinances to revise catering service requirements.

DRAFTER'S ANALYSIS:  This proposal modifies existing City ordinances to be consistent with Wisconsin Department of Revenue Guidelines regarding catering of alcohol beverages.  It repeals the existing provision of City ordinances that prohibits an alcohol beverage licensee from supplying bartenders or pouring alcohol beverages and permits a licensee to supply personnel at a catered event.  It clarifies that a licensee may not cater onto another licensed premise, as provided by state law.  It also states, as provided by state law, that alcohol beverages may not be sold by the glass at a catered event, where a licensee has provided such alcohol beverages.  This subsection does not prohibit an eligible group from obtaining a temporary Class B "picnic" license and holding an event where alcohol is sold by the glass, provided the alcohol has been obtained from a licensed wholesaler.  This proposal also repeals language that requires a licensee to give the Madison Police Department specified information about the event 15 days prior to the catered event.

The Common Council of the City of Madison do hereby ordain as follows:
      Subsection (12) entitled "Catering Service Requirements" of Section 38.05 entitled "General Licensing Requirements" of the Madison General Ordinances is amended to read as follows:
"(12)      Catering Service Requirements. In any case where the licensee operates or conducts a business in which the licensee provides food for consumption off the licensed premises, commonly known as a catering service, the following shall apply to the providing of alcohol beverages as part of the catering services, in addition to all other laws:
(a)      Not less than fifteen (15) days prior to the catered event, the licensee shall provide to the Madison Police Department the name, address and telephone number of the person in charge of the event, the beginning and ending hours of the event and the event's location if different from that of the person in charge.
(ba)      The licensee shall deliver alcohol beverages to an event only when licensee supplies full food catering service for all guests of or participants in the event.  No licensee shall deliver alcohol beverages for an event that is held on the premise of another alcohol beverage licensee, including the premise of a temporary Class "B" Beer (picnic) license or a temporary "Class B" Wine "picnic" license.
(cb)      No licensee shall sell, deal or traffic in alcohol beverages except on the licensed premises of the licensee. This provision shall not prevent nor prohibit the licensee from delivering goods to the buyer as accommodation.
(dc)      The licensee and employees or agents shall not act as bartender nor pour alcoholic beverages for or at the event The licensee may supply personnel to dispense alcohol beverages at a catered event. No person shall engage in the individual sale of alcohol beverages to be consumed by the glass at a catered event ("cash bar"), when the alcohol beverages have been supplied by a retail licensee."
