PREAMBLE
 
 
The City of Madison has solicited consulting proposals for Engineering Services for the Replacement of the Milwaukee Street Bridge over the West Branch of the Starkweather Creek.  The City Engineer has reviewed the proposals and has selected MSA Professional Services, Inc to provide the Engineering Services.  The Milwaukee Street Bridge is in poor condition and the City Engineer has determined that the bridge should be replaced.  Federal Bridge Funds have been approved for the design and construction of the project.  This consulting agreement will provide for public involvement, environmental assessment and preparation of plans and specifications.  In addition, the agreement will provide for sanitary main plans within the project limits.  The construction of the project is scheduled for 2005. Both the design and construction will be funded with 20% City funds and 80% Federal funds.
 
The City of Madison Common Council adopted on April 15, 2003 Resolution No. 60455, File I.D. No. 33831 Authorizing the Mayor and City Clerk to enter into an agreement for design engineering services with the State of Wisconsin Department of Transportation and MSA Professional Services, Inc for the Milwaukee Street Bridge over the West Branch of the Starkweather Creek.
 
The City of Madison Common Council has sponsored and introduced on March 15, 2007 a Resolution Authorizing the Mayor and City Clerk to execute Amendment 2 to the present agreement between the City of Madison, MSA Professional Services, Inc. and the State of Wisconsin Department of Transportation for the Milwaukee Street Bridge over the west branch of the Starkweather Creek, Contract No. 5534, for additional engineering services.  (15th AD)
 
City Engineering has created Engineering Project No. 53B0979 - Milwaukee Street Bridge, cooperatively with WDOT Project No. 5992-07-49 (Right-of-Way), 5992-07-50 (Construction), 5992-07-71 (Construction), and will proceed with a Resolution Approving Plans, Specifications, And Schedule Of Assessments for planned improvements to Milwaukee Street approaches to, and including the removal of existing bridge structure P-13-729 and replace with bridge structure B-13-577. There will also be Starkweather Creek West Branch stream bank stabilization work done in close proximity to this bridge structure.
 
To perform this planned improvement, it is necessary to acquire land interests from one (1) property at 3029 Milwaukee Street to facilitate the proposed public improvements planned with Engineering Project No. 53B0979 - Milwaukee Street Bridge.
 
The Plat of Right-of-Way WDOT Project No. 5992-07-49 required for the completion of the Milwaukee Street Bridge and Approaches and Starkweather Creek West Branch stream bank stabilization is attached and made part of this Resolution.
 
Preliminary construction plans are also attached for reference and made part of this Resolution.
 
The City of Madison Real Estate Department has created Project No. 8719 - as a master file to administer all necessary land interest acquisitions.
 
BE IT RESOLVED, the City of Madison, Dane County, Wisconsin, by its City Council and for its Relocation Order hereby resolves as follows:
 
1.      That this Resolution is a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes for the purpose of the within described public acquisition project and that this acquisition is determined to be necessity in accordance with Section 32.07(2), Wisconsin Statutes, and the acquisition shall allow for the construction of public improvements related to Engineering Project No. 53B0979 - Milwaukee Street Bridge and WDOT Project No. 5992-07-49 (Right-of-Way), 5992-07-50 (Construction), 5992-07-71 (Construction).
 
2.      That the City of Madison Real Estate Section of the Community and Economic Development Unit and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Relocation Order, and the Real Estate Section is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition.
 
3.      That the City of Madison Real Estate Section of the Community and Economic Development Unit is hereby authorized to execute the jurisdictional offer, lis pendens, and award of the compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary.
 
4.      That the Mayor and City Clerk are authorized to sign all necessary documents necessary to accomplish the acquisition.
