Accepting a Warranty Deed, at no cost to the City of Madison, from Joseph Donnino, Jr., Donald L. Jones and Thayer Properties, LLC, dedicating land for public right-of-way purposes, for the property located at 698 South Whitney Way.
Body
WHEREAS, as a condition of approval a demolition permit and conditional use for the property located at 698 South Whitney Way, the City Traffic Engineering Division is requiring the current owner, Joseph Donnino, Jr., Donald L. Jones and Thayer Properties, LLC, (the "Owners") to dedicate, no cost to the City, additional public right-of-way for South Whitney Way and Odana Road; and
 
WHEREAS, the Owners have executed a Warranty Deed for said dedication; and
 
WHEREAS, City Engineering and Traffic Engineering Divisions have reviewed same and recommend that said dedication be accepted.
 
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorized the acceptance of a Warranty Deed from Joseph Donnino, Jr., Donald L. Jones and Thayer Properties, LLC for the dedication of additional public right-of-way for South Whitney Way and Odana Road, at no cost to the City, more particularly described as follows:
                                                           
Part of the Northeast Quarter of the Southwest Quarter of Section 30, Township 07 North, Range 09 East, City of Madison, Dane County, Wisconsin more particularly described as follows:
 
Commencing at the South Quarter corner of Section 30, aforesaid; thence North 00 degrees 04 minutes 55 seconds West along the East line of said Southwest Quarter, 1531.84 feet; thence North 89 degrees 56 minutes 22 seconds West, 60.00 feet  to the West right-of-way line of South Whitney way, and the Point of Beginning; thence South 00 degrees 04 minutes 55 seconds East, (Recorded as South 00 degres28 minutes East), along said West right-of-way line, 143.16 feet to a point of curve; thence Southwesterly 30.54 feet along an arc of a curve to the right, having a radius of 20.00 feet, the chord bearing South 43 degrees 39 minutes 58 seconds West, (Recorded as South 43 degrees 16 minutes 13 seconds West), 27.66 feet to the Northerly right-of-way line of Odana Road; thence  South 87 degrees 24 minutes 52 seconds West, (Recorded as South 87 degrees 01 minutes 07 seconds West), along said Northerly right-of-way line, 129.61 feet, (Recorded as 129'); thence North 00 degrees 06 minutes 42 seconds West, (Recorded as North 00 degrees 37 minutes West), 7.01 feet; thence North 87 degrees 24 minutes 52 seconds East, 131.40 feet to a point of curve; thence Northeasterly 22.91 feet along an arc of a curve to the left, having a radius of 15.00 feet, the chord bearing North 43 degrees 39 minutes 58 seconds East, 20.74 feet; thence North 00 degrees 04 minutes 55 seconds West, 141.08 feet; thence South 89 degrees 56 minutes 22 seconds East, (recorded as North 89 degrees 32 minutes 10 seconds East), 3.00 feet to the Point of Beginning.   
 
Said dedication contains 1,474 square feet.
