Title

Authorizing the Board of Health for Madison and Dane County on behalf of Public Health Madison & Dane County to execute a Second Amendment to the Lease with the Community Development Authority of the City of Madison for The Village on Park (Atrium Suites 2009, 2011, 2012, and 2022) and authorizing the Director of Public Health to Execute the Lease Agreement (2026 RES-176)

Body

Public Health Madison & Dane County (“Public Health”), the joint City-County public health department, seeks authorization to execute a second amendment to its lease with the Community Development Authority of the City of Madison (“CDA”) for health department office space in the north end of The Village on Park at 2300 South Park Street (Atrium (ATR) Suites 2009 (Kitchenette), 2011, 2012, and 2022) described in Exhibit D. Suite 2024 was previously part of the leased premises but no longer exists as a separate suite due to the removal of the interior wall between Suites 2024 and 2022, resulting in one combined space now designated as Suite 2022; This space will continue to be used as office space for programs and administrative operations.

WHEREAS, the Community Development Authority of the City of Madison (“CDA”) is the owner of The Village on Park, located at 2300 South Park Street; and

WHEREAS, the CDA and the Board of Health for Madison and Dane County on behalf of Public Health Madison & Dane County are parties to a lease recorded on November 15, 2016 as Document Number 5284825; and corrected with an Affidavit of Correction recorded on December 16, 2016 as Document Number 5292403; and a First Amendment recorded on December 18, 2017 as Document Number 5378665 with the Dane County Register of Deeds (collectively, the “Lease”); and

WHEREAS, Public Health utilizes Suites 2009 (Kitchenette), 2011, 2012, and 2022 at the Atrium as office space for community health, environmental health programs, as well as programs that use the clinic space, and related program activities; and

WHEREAS, the Lease included a five-year option to extend the lease term to December 31, 2031, which Public Health did not exercise due to ongoing discussions with the CDA regarding relocation of Public Health operations to the new Park Badger redevelopment building in 2029; and

WHEREAS, the Lease will expire on December 31, 2026, with no remaining options to renew; and

WHEREAS, CDA and Public Health desire to enter into a second amendment to the Lease to allow continued use of the space until the Park Badger redevelopment building is complete and a new lease for Public Health to use that space can be negotiated; and

WHEREAS, CDA staff and Public Health have agreed to a new 26-month term with twelve (12) one-month renewal options, with rental rates based on the amounts listed in the expired option to renew.

NOW THEREFORE BE IT RESOLVED that the Director of Public Health, or their designee is authorized on behalf of the Board of Health for Madison and Dane County, acting on behalf of Public Health Madison & Dane County, to execute a second amendment to the lease agreement with the Community Development Authority of the City of Madison, at the rental price and for the duration described above, for Public Health’s continued use of office space at 2300 South Park Street (Atrium Suites 2009 (Kitchenette), 2011, 2012, 2022), and the Director is further authorized to sign the twelve (12) one-month renewal options, and other amendments as needed as long as budgetary authority exists for the same.
