Inspection Unit does not anticipate additional enforcement costs related to this ordinance. Enforcement would be added to standard inspection procedures. Housing Operations has successfully converted all common area bulbs to meet the requirements of this ordinance. Housing Operations anticipates some initial costs in converting all fixtures within units to fluorescent or light emitting diode bulbs. These costs will be at least partially offset through energy savings in units with Utilities paid by Housing Operations and by less frequent replacement of bulbs.

SUBSTITUTE - Creating Sections 27.05(2)(aa), (bb), and (cc) and Section 29.20(21) of the Madison General Ordinances to require the use of compact fluorescent or light emitting diode bulbs in certain buildings.

DRAFTER'S ANALYSIS: The purpose of this amendment is to improve tenant safety and to reduce electricity use, pollution, and the need for new electric transmission lines.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (aa) of Subsection (2) of Section 27.05 entitled "Safe and Sanitary Maintenance of Property" of the Madison General Ordinances is created to read as follows:
"(aa) In all buildings containing three (3) or more rental dwelling units, illumination in all common areas shall be provided by fluorescent or light emitting diode bulbs or any other bulb that has an energy efficiency of at least fifty (50) lumens per watt."
2. Subdivision (bb) of Subsection (2) of Section 27.05 entitled "Safe and Sanitary Maintenance of Property" of the Madison General Ordinances is created to read as follows:
"(bb) Notwithstanding Subdivision (aa), required exit lights in all buildings containing three (3) or more rental dwelling units and that are more than six (6) stories or sixty (60) feet in height and in all buildings containing three (3) or more rental dwelling units and that are up to six (6) stories or sixty (60) feet in height that were constructed prior to January 1, 1993 shall contain light emitting diode bulbs."
3. Subdivision (cc) of Subsection (2) of Section 27.05 entitled "Safe and Sanitary Maintenance of Property" of the Madison General Ordinances is created to read as follows:
"(cc) All mounted fixtures with Edison bases that are in rental dwelling units in buildings with three (3) or more dwelling units shall have a compact fluorescent or light emitting diode bulb or any other bulb that has an energy efficiency of at least fifty (50) lumens per watt at the beginning of each lease period. This requirement shall not apply to fixtures controlled by dimmer switches or to any fixtures in appliances."
4. Subsection (21) of Section 29.20 entitled "Items to be Enforced Over Wisconsin Administrative Code" of the Madison General Ordinances is created to read as follows:
"(21) Required exit signs in all buildings containing three (3) or more rental dwelling units and that are more than six (6) stories or sixty (60) feet in height shall contain light emitting diode bulbs."
5. The effective date of this ordinance shall be January 1, 2008.
