Title

Authorizing the release of a public right-of-way reservation that encumbers the property located at 3394 E. Washington Avenue.

Body

WHEREAS, the City of Madison (the "City") in Dane County, Wisconsin, required a reservation for a future public right-of-way, shown as a proposed street on the City of Madison Official Map, said map established by Ordinance No. 2091 on the 11^th day of August 1966; and

WHEREAS, the proposed street is an extension of Ridgeway Avenue and crosses a parcel of land described on attached Exhibit A, with said proposed street (the "Reservation Area") depicted on attached Exhibit B; and

WHEREAS, the Reservation Area is not recorded with the Dane County Register of Deeds and remains undeveloped, with no City funds expended for said Reservation Area; and

WHEREAS, Dane County Credit Union (the "Owner") approached the City to request the reservation release; and

WHEREAS, City Engineering and Traffic Engineering support the release of the reservation because street connectivity for the adjacent Carpenter-Ridgeway Neighborhood is provided by Carpenter Street and site topography in the Reservation Area is not desirable for a public street connection; and

WHEREAS, the City has no future interest in developing or maintaining the land within the Reservation Area and there are no existing or proposed public utility facilities in said area; and

WHEREAS, the Office of Real Estate Services will prepare a Release of Easement for Right-of-Way Purposes document to be recorded with the Dane County Register of Deeds to memorialize the release.

NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison authorizes the release of any and all rights to the public right-of-way reservation set forth in the City of Madison Official Map for the property described on attached Exhibit A, with said Release Area depicted on attached Exhibit B; and  

BE IT STILL FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute, deliver, accept, and record such documents and to take such other actions as shall be necessary or desirable to accomplish the purpose of this resolution.
