Title
Authorizing the execution of a Release of a Permanent Easement for Public Sidewalk and Bus Pad Purposes at Madison Area Technical College, located at 1702 Wright Street.
Body
WHEREAS, the City of Madison was party to an agreement with Madison Area Technical College (“MATC”) dating back to 1996 for the installation of a public sidewalk and bus pad at 1702 Wright Street; and
WHEREAS, pursuant to said agreement, Dane County and Madison Area Technical College granted a Permanent Easement for Public Sidewalk and Bus Pad Purposes (the “Easement”) to the City of Madison as recorded on May 27, 1998, as Document No. 2974219 in the Dane County Register of Deeds Office, City of Madison, Dane County, Wisconsin; and
WHEREAS, said public sidewalk and bus pad facilities were subsequently installed within the existing right-of-way of Wright Street and therefore eliminating the need for said Easement; and
WHEREAS, Madison Metro recently reviewed said Easement and recognized that said Easement should be released; and
WHEREAS, the City Engineering and Traffic Engineering Divisions, and Madison Metro have reviewed and approve of the release of said Easement.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Release of a Permanent Easement for Public Sidewalk and Bus Pad Purposes, recorded on May 27, 1998, as Document No. 2974219 in the Dane County Register of Deeds Office, City of Madison, Dane County, Wisconsin; as described as follows:
Legal Description of Easement Area to be Released
A part of the Southwest ¼ of the Southeast ¼ of Section 29, Town 8 North, Range 10 East, City of Madison, Dane County, Wisconsin, more particularly described as follows:
Commencing at the point of intersection of the North line of the 80.00 foot right-of-way of Anderson Street with the West line of the 100.00 foot right-of-way of Wright Street; thence N01°54’57”E, along the West right-of-way line of Wright Street, 310 feet to the point of beginning; thence continuing N01°54’57”E, along said West right-of-way line, 350.00 feet; thence N88°05’03”W, perpendicular to said West right-of-way line, 10.00 feet; thence S01°54’57”W, parallel with and 10.00 feet West of, measured at right angle to the said West right-of-way line, 350.00 feet; thence S88°05’03”E, 10.00 feet to the point of beginning. Said easement contains 3,500 square feet.
