The proposed resolution authorizes a non-competitive purchase of services contract with Destree Design Architects, Inc. for preparation of bid documents, assistance in the bid process and construction administration services of a new Warner Park Beach Shelter located in Warner Park on Woodward Drive. The cost of this agreement is $90,000, which is budgeted within the adopted 2019 Capital budget in Engineering-Facilities Management, Park Facility Improvements Capital program. In 2019, $910,000 of GF GO Borrowing is budgeted within the program for these costs.

Body
WHEREAS, the 2019 Capital Budget includes $910,000 for Engineering-Facilities Management, Park Facility Improvements and,
WHEREAS, Destree Design Architects, Inc. is a local City of Madison firm, and certified by the City of Madison as a Women Business Enterprise, and certified by the City of Madison as a Small Business Enterprise; and
WHEREAS, this contract is for the preparation of bid documents, assistance in the bid process, and construction administration services for the construction of a new Warner Park Beach Shelter located in Warner Park on Woodward Drive; and,
WHEREAS, additional professional design services shall include civil, architectural, structural, HVAC, plumbing, electrical engineering and other disciplines as required; and,
WHEREAS, the project will expedite the implementation of the Park Restroom Prototype Building to replace an existing undersized and outdated building and shelter and accommodate the new beach exclosure equipment to help clean beach water; and,
WHEREAS, Destree Design Architects, Inc has expertise on park restroom buildings and public process and has completed a contract for architectural and engineering design services for the Park Restroom Prototype Building in 2015, and has provided previous and continuing design services for prototype shelters located at Lake Edge, Esther Beach, Penn Park and Walter Street; and,
WHEREAS, MGO 4.26 requires Common Council approval of service contracts of $50,000 or more if the contractor was not selected through a competitive selection process, and the reasons for selecting this contractor are set forth above; and,
WHEREAS, the proposed contract with Destree Design Architects, Inc. meets the exception to the bidding process in section 4.26(4)(a)7. which states “A particular consultant has provided services to the City on a similar or continuing project in the recent past, and it would be economical to the City on the basis of time and money to retain the same consultant”.
NOW, THEREFORE BE IT RESOLVED that the Common Council hereby authorizes the Mayor and City Clerk to execute a purchase of services contract with Destree Design Architects, Inc. to provide for professional architectural and engineering services for the Warner Park Beach Shelter as described above and payment in the amount not to exceed $90,000.
