Focus on Energy has authorized $57,785.56 in energy incentive funding for the expansion of the Engineering Division’s Operations Building.
The budget amendment needed to spend this additional funding is as follows:

Title
Amending the 2015 Capital Budget and Authorizing the City Engineer to execute an incentive agreement and any associated documents with Focus on Energy for incentive payments to the City of Madison for renewable energy and/or energy efficiency measures constructed at the Engineering Division’s Operations Building at 1600 Emil Street.
Body
WHEREAS, the Engineering Division’s Operations Building is being expanded to alleviate overcrowding, provide a safe, efficient working environment and protect investment in vehicles and equipment;
WHEREAS, the addition’s design incorporates measures to increase energy efficiency and on-site generation of renewable energy; and
WHEREAS, Focus on Energy offers grants to governmental entities as an incentive to incorporate energy efficient and renewable energy generation measures into building projects; and
WHEREAS, the grant agreements may contain a provision which requires the City to hold harmless, indemnify, and defend against liability, damage, claims or suits which arise out of the services provided by Focus on Energy and equipment for which the incentive is provided; and
WHEREAS pursuant to APM No. 1-1, the inclusion of such a provision requires the express approval of the Common Council; and
WHEREAS the 2015 Capital Budget needs to be amended to allow for spending of this additional funding on energy efficiency and renewable energy improvements in the project.
NOW THEREFORE BE IT RESOLVED, that the Common Council authorizes the City Engineer to execute an incentive agreement and any associated documents with Focus on Energy for incentive payments to the City of Madison for renewable energy and/or energy efficiency measures constructed at the Engineering Division’s Operations Building at 1600 Emil Street; and
BE IT FURTHER RESOLVED, that the incentive agreement shall be in
in a form that has been approved by the City Attorney and the Risk Manager and may contain an indemnification clause; and
BE IT FINALLY RESOLVED, that the 2015 Capital Budget is hereby amended to increase the budget authority in the ESB Expansion project (10308) by $57,800, funded by Focus on Energy rebates.
