Amending the 2009 Adopted Capital Budget of Engineering-Other and approving plans and specifications for public improvements necessary for the project known as Starkweather West Branch Path and authorizing the Mayor and the City Clerk to execute a cost sharing and construction agreement with the State of Wisconsin Department of Transportation. (14th, 15th, & 17th ADs)

Starkweather Creek Path and Aberg Bridge:
The City is proposing to construct a multi-use (bicycle and pedestrian) path connecting the existing Starkweather Creek Path at Commercial Avenue to the existing Starkweather Creek path north of Aberg Avenue, including a new bridge over Aberg Avenue.
The City applied for and was awarded a federal grant under the State-administered Transportation Enhancements or Bicycle and Pedestrian Facilities Program covering approximately 50% of the project costs.
The City has budgeted $1,440,000 for the local share of this project in 2010. However, we accelerated design of this project anticipating that the new administration would provide additional infrastructure funding as an economic stimulus measure and we are now in a position to seek additional funding from the proposed Federal Stimulus Phase 1 program in order to advance this project for 2009 construction.
The project would be constructed under a contract let by the Wisconsin Department of Transportation, which would also be responsible for oversight of the construction. A project Agreement with WisDOT will be required, covering funding and construction.
The City's consultant has substantially completed plans and specifications for the project.
The City will have completed acquisition of all easements necessary for construction of the project to meet the schedule for Stimulus funding.
Cannonball Path and Beltline Bridge:
The City is also proposing to construct a multi-use (bicycle and pedestrian) path on the former Union pacific Railroad corridor, recently acquired by the City. The critical and most expensive phase of this project is a bridge over Beltline Highway in the vicinity of Todd Drive. This phase is currently not programmed until after 2011. If this project is designed by December 1, 2009 it may be eligible for funding under Phase 2 of the Federal Stimulus program. This program requires that the project be State-let. Due to its complexity and the short time frame, Engineering proposed to retain a consultant for the design. Funds for this are not currently budgeted in 2009.
NOW THEREFORE BE IT RESOLVED:
1. That the plans and specifications for the Starkweather West Branch Path are hereby approved.
2. That the Mayor and City Clerk are hereby authorized to execute an agreement with the State of Wisconsin Department of Transportation for the funding, construction and construction oversight for the project.
3. That the Mayor and City Clerk are authorized to execute any other documents necessary to construct this facility, and specifically including those related to the additional funding being sought and those related to easement acquisition.
4. That the City of Madison Capital Budget for Engineering - Other Projects for 2009 is hereby amended to add $280,000 funding for Aberg Ped / Bike Overpass to cover approximately 10% of the cost of the project and unforeseen contingencies, conditional on the City receiving additional Federal Stimulus funds covering the remainder of the cost
5. That the City of Madison Capital Budget for Engineering - Other Projects for 2009 is hereby amended to add $265,000 funding for design engineering of the Cannonball Bike Trail - Beltline Bridge phase.
6. That the Mayor and City Clerk are authorized to execute all necessary agreements, including an agreement with the State of Wisconsin, Department of Transportation for the funding, construction and construction oversight for the Cannonball Bike Trail - Beltline Bridge project.
Fiscal Note
The budget amendment contained in this Resolution increases the budget authority in the Aberg Ped/Bike Overpass (Project 5) and the Cannonball Bike Trail (Project 9) of the 2009 Engineering Other Capital Budget. This budget amendment will be funded through additional GO Borrowing in 2009.
