Fiscal Note

This resolution authorizes a three-year agreement with CrossFit, Inc. for the use of the Olin Park Boat Launch. The agreement will set forth the terms and conditions upon which the City will allow CrossFit, Inc. to temporarily close and use the Olin Park Boat Launch for the production of the CrossFit Games. In addition to the special event fees established during the application and review process, CrossFit, Inc. will pay the City an anticipated $15,000 over the term of the agreement. These revenues will be recognized as follows: $5,000 in 2017, $5,000 in 2018 and $5,000 in 2019.

Authorizing the City to execute an agreement with CrossFit, Inc  for the temporary closure and private use of the Olin Park Boat Launch for the annual production of the CrossFit Games for the years of 2017-2019.

Body

WHEREAS, the City of Madison Parks Division maintains numerous piers and boat launches throughout the City that provide residents and visitors access to the City’s lakes and waterways, including a boat launch at Olin Park on Lake Monona; and,

WHEREAS, the CrossFit Games (“Event”) will occur in Madison, WI in 2017, 2018 and 2019 through the Madison Area Sport Commission’s efforts to bring the event to the City; and,

WHEREAS, the Event is a premier international competition and will be a signature Madison activity that is enjoyed by the local community, and that attracts tourism and economic development to Madison; and,

WHEREAS, the Event will be staged, in part, within Olin-Turville Park, the use of which will be subject to various other City permits; and,

WHEREAS, CrossFit, Inc. (“CrossFit”) has expressed a desire to use the Olin Park boat launch area (the “Boat Launch Area”) for the Event, the closure and use of which will allow for a successful competition, improved Event operations, and competitor and pedestrian safety in the Olin-Turville Park area during the Event; and,

WHEREAS, on May 10, 2017, the Board of Parks Commissioners approved CrossFit’s request to close the Boat Launch Area as part of the Park Event Permit Application; and,

WHEREAS, CrossFit has a three-year term to host the Event in Madison, and the City wishes to support the Event by allowing the annual temporary closure and use of the Boat Launch Area; and,

 

WHEREAS, Section 8.188 of the Madison General Ordinances requires a valid agreement between the City and CrossFit for the use of a boat launch in this manner.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to enter into a Use Agreement with CrossFit, Inc. to close and use the Olin Park Boat Launch for the production of the CrossFit Games for the years of 2017-2019, consistent with the Olin Park Boat Launch Closure and Use Agreement attached and incorporated hereto, in a format that is approved by the City Attorney and the Risk Manager; and,

BE IT FURTHER RESOLVED that the Superintendent of Parks is delegated the authority to act on behalf of the City as set forth in the Agreement.
