Title
Amending Section 38.06(12) of the Madison General Ordinances to change the title of the subsection regulating centers for visual and performing arts to more accurately reflect what the ordinance regulates and to clarify security plan requirements for establishments applying for this license.

DRAFTER'S ANALYSIS: This amendment is primarily a change to the title to more accurately reflect what the ordinance regulates. The amendment also clarifies the term "live entertainment" and establishes requirements for a more detailed security plan for applicants.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subsection (12) entitled "Centers For Visual And Performing Arts" of Section 38.06 entitled "General Provisions and Hours" of the Madison General Ordinances is amended to read as follows:
"(12) 18+ Centers For Visual And Performing Arts."
2. Subdivision (c) entitled "Definitions" of Subsection (12) entitled "Centers For Visual And Performing Arts" of Section 38.06 entitled "General Provisions and Hours" of the Madison General Ordinances is amended by amending therein the following:
"Live Entertainment" means a performance live music or disc jockey performance being heard and/or viewed at the time of performance and in the physical presence of a live audience.
3. Subparagraph g. of Paragraph 1. of Subdivision (d) entitled "Application" of Subsection (12) entitled "Centers For Visual And Performing Arts" of Section 38.06 entitled "General Provisions and Hours" of the Madison General Ordinances is amended to read as follows:
"g. A completed plan of operation which shall include: planned hours of operation for the premises; legal occupancy limit of the premises; how underage persons will be identified to insure they are not served alcohol beverages at the premise and to insure that alcohol beverages are not consumed by underage persons at the premise; the number of off-street parking spaces available at the premise; whether or not the premises will make use of sound amplification equipment and, if so, what kind; a written, detailed security plan for the premises, which includes: the number of security personnel the applicant will employ and how they will be utilized; detail regarding how the applicant will handle issues regarding control and clearance of the parking lot during hours of operation and at closing time; unruly patrons; patrons who are intoxicated; patrons presenting false ID's; control and supervision of patrons under the age of twenty-one (21) (if applicable); the circumstances under which police should be called and how physical disturbances, including fights, will be handled; the security plan shall also identify by name and date of birth, individuals who are employed by the establishment in a management capacity; how applicant will provide security for the premises; how applicant will maintain the orderly appearance and operation of the premises with respect to litter and noise; any other licenses held by the applicant or attached to the premises; such other reasonable and pertinent information the ALRC or common council may from time to time require."
