Accepting two abutting Permanent Limited Easements for Public Storm Sewer and Storm Water Drainage Purposes: one easement from Tisha N. Kawahara across the property located at 4321 Regent Street, and one easement from Bradly A. Green and Jessica L. Green across the property located at 1 South Meadow Lane. (11th A.D.)
Body
WHEREAS, a storm water drainage inlet (the “Inlet”) and drainage way exist along the common parcel boundary between 4321 Regent Street and 1 South Meadow Lane (the “Properties”); and
WHEREAS, the Inlet is connected with a storm sewer pipe to the City of Madison (“City”) storm sewer system lying within the adjacent right-of-way of Regent Street; and
WHEREAS, Tisha N. Kawahara, owner of the property located at 4321 Regent Street, and Bradly A. Green and Jessica L. Green, owners of the property located at 1 S. Meadow Lane (together, the “Owners”), have expressed to the City a concern that during rain events the Inlet is not properly draining the storm water along the shared boundary between the Properties, resulting in storm water ponding on the Properties; and
WHEREAS, the Owners and City Engineering agree that the City should assume ownership, repair and maintenance of the Inlet and associated storm water drainage appurtenances (collectively, the “Facilities”) in order to improve the drainage function of the Inlet; and
WHEREAS, the Owners each wish to dedicate to the City of Madison a Permanent Limited Easement for Public Storm Sewer and Storm Water Drainage Purposes for the Facilities and have executed the necessary easements, and the City of Madison Engineering Division has reviewed and recommends acceptance of the easements.
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison hereby accept the two respective Permanent Limited Easements for Public Storm Sewer and Storm Water Drainage Purposes, at no cost, from the Owners across the Properties described in attached Exhibit A and depicted in attached Exhibit B (the “Easement Areas”).
